Benchmark Thermal [hereafter known as Seller] warrants that the products manufactured and sold as new by Seller will be free from any defects in parts and workmanship and shall conform in all respects to the specifications agreed between Buyer and Seller. The Warranty Period for products covered under this warranty is Twelve Months from date of shipment from seller and is based on the terms and conditions listed below. THIS IS THE ONLY WARRANTY MADE BY SELLER AND IS MADE EXPRESSLY IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE.
Should any parts or workmanship prove defective, after written notice by Buyer to Seller and inspection by Seller, Seller will, at Seller’s sole option, repair or replace the part or parts at no cost to Buyer for the warranty period. Seller shall not be liable for loss, damages or expenses, directly or indirectly, arising from misuse or neglect of, or accidents involving the goods and to improper repair, installation, maintenance or operation of the product(s).
Buyer, after having obtained Seller’s authorization in the form of a Seller assigned RGA (Return Goods Authorization) number, will ship good(s) to Seller. Seller will repair or replace such good(s) that Seller determines are defective; provided, however, that Seller shall not be required to reimburse Buyer for any costs incurred by Buyer arising from the removal of defective parts, the installation of replacements parts or otherwise in connection with such warranty services.
The remedy provided herein as to repair or replacement of parts shall be Buyer’s sole and exclusive remedy.
This Warranty vests only with the original purchaser from Benchmark Thermal and is not transferable. Users and distribution dealers for equipment upon which Benchmark Thermal products are installed must look to the original manufacturer of that equipment for warranty service.
